Provider: 12 Paws Software, LLC, operating the Homeschool Ace service (“Homeschool Ace,” “we,” “us,” or “our”).
Participant: You, the individual or household accepting these terms (“you” or “Participant”).
By creating a beta account, accessing, or using the Homeschool Ace beta (the “Beta Service”), you agree to this Beta Participant Agreement (this “Agreement”). If you do not agree, please do not use the Beta Service.
You’re getting early access to Homeschool Ace while it’s still under development. The Beta Service is provided so you can try it and give us feedback. It is not a finished product.
You understand and agree that the Beta Service:
The whole point of the beta is your feedback. If you send us comments, suggestions, bug reports, feature ideas, or other input about the Beta Service (“Feedback”), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that Feedback into Homeschool Ace and our other products, without any obligation or compensation to you.
You won’t send us Feedback that you’re not free to share, or that includes someone else’s confidential or proprietary information.
Some parts of the Beta Service, unreleased features, screens you see before launch, and things we tell you directly are not yet public, aren’t public knowledge yet. We’d appreciate it if you didn’t publicly post screenshots or details of clearly unreleased features until we’ve launched them. This is a courtesy request, not a restriction on talking about your general experience.
You’re welcome, encouraged, even, to tell other homeschool families that you’re using Homeschool Ace and what you think of it.
We know the information in Homeschool Ace is sensitive, it can include your children’s names and academic records. We take that seriously. Our handling of your data is governed by ourPrivacy Policy, which is incorporated into this Agreement by reference.
You’re responsible for the accuracy of the information you enter and for having the right to enter any information about members of your household. Because this is a beta, please keep your own backup of important records (see Section 1).
The Beta Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Beta Service will be uninterrupted, error-free, secure, or that any data will be preserved.
To the fullest extent permitted by law, Homeschool Ace and its owners will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Beta Service. Our total liability for any claim related to the Beta Service will not exceed USD $100.00. Because the Beta Service is provided free of charge, you acknowledge this limitation is reasonable.
This Agreement starts when you first access the Beta Service and continues until the beta period ends or either of us ends it. We may suspend or end your access, or discontinue the beta, at any time and for any reason.
When the beta ends, we’ll make a reasonable effort to let you know what happens to your data, for example, whether you can carry it over into the paid version of Homeschool Ace, or whether it will be deleted. Sections 2, 5, 6, and 9 survive termination.
From time to time we may ask if we can share your comments about Homeschool Ace. We will only use your name or a quote from you in our marketing with your permission, which you can give or decline when we ask.
By clicking “I agree” (or by accessing or using the Beta Service), you acknowledge that you have read and agree to this Beta Participant Agreement.
